الحق في التصويت في الانتخابات

خلاصة

يعد التصويت وسيلة هامة وأساسية يمكن للأفراد من خلالها التأثير على القرارات الحكومية. والتصويت هو قيام الفرد باختيار أحد المرشحين لتمثيله في الهيئات المنتخبة التي تتولى إعداد القوانين أو في بعض مناصب اتخاذ القرارات.

غالبا ما يجري التصويت ضمن عملية انتخاب تتم على المستوى الوطني أو المقاطعة. ومن الجدير بالانتباه أن الانتخابات المحلية أو على مستوى البلديات تعد بذات أهمية الانتخابات المتعلقة بالهيئات الوطنية أو الإقليمية.

الإعلان العالمي لحقوق الإنسان: جرى اعتماده من قبل الجمعية العامة للأمم المتحدة في عام 1948 بما يشبه الإجماع، وقد أقر الإعلان بما للانتخابات النزيهة والشفافة من دور في ضمان إعمال الحق في المشاركة في الشؤون العامة.

وقد نصت المادة 21 من الإعلان العالمي لحقوق الإنسان على أن:
– لكل شخص حق المشاركة في إدارة الشئون العامة لبلده، إما مباشرة وإما بواسطة ممثلين يختارون في حرية.
– لكل شخص، بالتساوي مع الآخرين، حق تقلد الوظائف العامة في بلده.
– إرادة الشعب هي مناط سلطة الحكم، ويجب أن تتجلى هذه الإرادة من خلال انتخابات نزيهة تجرى دوريا بالاقتراع العام وعلى قدم المساواة بين الناخبين وبالتصويت السري أو بإجراء مكافئ من حيث ضمان حرية التصويت.

وقد جرى التأكيد على ما لإجراء انتخابات دورية ونزيهة من دور في احترام الحقوق السياسية في العديد من الصكوك الدولية والإقليمية كالعهد الدولي الخاص بالحقوق المدنية والسياسية والاتفاقية الأوروبية لحقوق الإنسان وميثاق منظمة الدول الأمريكية والميثاق الأفريقي لحقوق الإنسان والشعوب.
وفيما تم الإقرار بالحق في التصويت كأحد الحقوق الأساسية إلا أنه لم يتم بعد احترام إعماله فيما يخص الملايين من الأفراد في مناطق العالم المختلفة.

تحرم العديد من المجموعات من التمتع بهذا الحق كغير المواطنين وصغار السن وبعض الأقليات ومقترفي بعض الجرائم والأفراد المشردين والجماعات المشردة داخليا فضلا عن أفراد وجماعات أخرى من أولئك المحرومين من التمتع بالحق في التصويت لأسباب مختلفة بما في ذلك الفقر والأمية والاضطهاد والخوف وعدم سلامة إجراءات العملية الانتخابية. ويلعب نمو المنظمات التي تقوم بمراقبة الانتخابات دورا هاما في الحد من الحرمان من التمتع بالحق في التصويت.

وتواجه الحكومات تحديات مختلفة تجاه الوفاء بالحق في انتخابات حرة ونزيهة على النحو المقرر في الإعلان العالمي لحقوق الإنسان. وتقوم الهيئات المعنية بمراقبة الانتخابات والتي قد تأخذ صور مختلفة سواء جماعات محلية أو فريق الأمم المتحدة المعني بتقديم المساعدة فيما يخص العملية الانتخابية – بتقديم المساعدة للحكومات والأطراف المحلية من أجل العمل على تنظيم انتخابات حرة ونزيهة وذلك عبر رصد العملية من البداية (توعية الناخبين، المرشحين، الحملة الانتخابية، الإعداد لعملية التصويت) إلى مرحلة عد الأصوات وإعلان النتائج. يضفي إقرار جماعات مراقبة الانتخابات بأن العملية الانتخابية اتسمت بالحرية والنزاهة – المشروعية على نتائج الانتخابات.

فيما قد يكون لحجب مثل تلك الشرعية عن نتائج الانتخابات وذلك بإعلان أنها لم تكن حرة ونزيهة – نتائج سياسية معقدة وخطيرة إذ يمكن أن تندلع أعمال شغب أو لربما قد يسفر ذلك عن حرب أهلية.

تعد الضمانات الواردة في المادة 25 من العهد الدولي الخاص بالحقوق المدنية والسياسية ذات أهمية بالغة فيما يخص الضمانات المتعلقة بالحق في التصويت وإجراء انتخابات حرة ونزيهة، وهي أيضا ذات صلة وثيقة بعدد من المواد الأخرى وعلى نحو خاص ما ورد في المادة 2 من العهد الدولي الخاص بالحقوق المدنية والسياسية .

وبخلاف ذلك فقد أقر العهد أيضا ضمانات تخص الحق في حرية التعبير (المادة 19)، والحق في التجمع السلمي (المادة 21)، وحرية تكوين الجمعيات (المادة 22) والحق في عدم التعرض للتمييز (المادة 26).

وتنص المادة 25 من العهد الدولي الخاص بالحقوق المدنية والسياسية على أن:
يكون لكل مواطن، دون أي وجه من وجوه التمييز المذكور في المادة 2، الحقوق التالية، التي يجب أن تتاح له فرصة التمتع بها دون قيود غير معقولة:
(أ) أن يشارك في إدارة الشؤون العامة، إما مباشرة وإما بواسطة ممثلين يختارون في حرية؛
(ب) أن ينتخب وينتخب، في انتخابات نزيهة تجرى دوريا بالاقتراع العام وعلى قدم المساواة بين الناخبين وبالتصويت السري، تضمن التعبير الحر عن إرادة الناخبين؛
(ج) أن تتاح له، على قدم المساواة عموما مع سواه، فرصة تقلد الوظائف العامة في بلده.

كما تنص الفقرة 1 من المادة 2 من العهد الدولي الخاص بالحقوق المدنية والسياسية أيضا على أن: 1- تتعهد كل دولة طرف في هذا العهد باحترام الحقوق المعترف بها فيه، وبكفالة هذه الحقوق لجميع الأفراد الموجودين في إقليمها والداخلين في ولايتها، دون أي تمييز بسبب العرق، أو اللون، أو الجنس، أو اللغة، أو الدين، أو الرأي سياسيا أو غير سياسي، أو الأصل القومي أو الاجتماعي، أو الثروة، أو النسب، أو غير ذلك من الأسباب.

فيما تحدد المادة 2 من العهد الدولي الخاص بالحقوق المدنية والسياسية بشكل واضح أنه يجب وفقا للمعايير الدولية ضمان الحق في التصويت والمشاركة في الانتخابات للكافة وأنه لا يجوز حرمان الفرد في أية دولة من التمتع بهذا الحق بناء على انتمائه لجماعة معينة سواء كان ذلك نتيجة إهمال أو سياسة منظمة – نجد أنه على سبيل المثال؛ قامت العديد من المجتمعات بالتعامل مع فجوة التصويت على صعيد نوع الجنس (ذكر أو أنثى)، حيث يكون أحد نوعي الجنس أكثر مشاركة في عملية التصويت من الآخر.

وتشير النظريات التقليدية فيما يتعلق بفجوة المشاركة – بين الرجل والمرأة – على صعيد نوع الجنس في العملية الانتخابية إلى أن الرجال دائما يشاركون ويهتمون أكثر من المرأة بالسياسة، وأنهم من ثم يشاركون في يوم الانتخابات بالتصويت بمعدلات أكثر من المرأة.

على أية حال، توضح الدراسات الحديثة إلى أن هناك نقطة تنقلب عندها “فجوة التصويت على صعيد نوع الجنس” تتمثل في تزايد اهتمام المرأة بالسياسة والعملية الانتخابية”.
