فتاوى دار الإفتاء الليبية .. السياق والأهمية

تاريخُ الإفتاء الليبي المعاصرُ

كان من المهم جدًا إخراج ما صدر من فتاوى تتعلق بالشأن الليبي، وهو ما صدر عن دار الإفتاء الليبية، في مجلدات عشرة، بعنوان: “فتاوى دار الإفتاء الليبية“، وهي فتاوى تتعلق بعَشر سنوات الثورة الليبية فقط، وهي فترة عمل الدار، فقد كانت هناك دار إفتاء من قبلُ، منذ أيام حكم السنوسية لليبيا، وكان ذلك سنة 1951م>

وكان الشيخ محمد أبو الإسعاد العالم من تولّى المنصب، كمُفتٍ عام للبلاد، واستمر على ذلك حتى بداية الستينيات، حيث خلفه الشيخ عبد الرحمن القلهود، وكان عالمًا له ثقله في العالم الإسلامي، وله بحث في غاية النفاسة والأهمية في المؤتمر الأوّل لمجمع البحوث الإسلامية بمصر، عن: التلفيق الفقهي، إلى أن عزل عن منصبه سنة 1969م مع قدوم القذافي.

استغلّ نظام القذافي الخلاف الذي كان بين الشيخ الطاهر الزاوي مع الملك السنوسي وعهده، فنصّبه مفتيًا، محاولًا استغلال ذلك في فتاوى توافق هواه، لكن المفتي كان صاحب مواقف رافضة مثل هذه الفتاوى، فضُيّق عليه حتى أُقفلت أبواب الدار، وأُلغي المنصب سنة 1983م.

ظلّ المنصب شاغرًا، مما اضطر الناس للجوء لأقطار أخرى للأسئلة، وطلب الفتوى، في ظل تضييق شديد على العلماء في ليبيا في عهد القذافي، إلى أن جاءت ثورة فبراير/شباط 2011م، وكان من أهم مكتسباتها استئناف فتح أبواب دار الإفتاء، وعودة المنصب والدار؛ لتقوم بدور لا تخطئه عين الراصد والدارس لليبيا ومجتمعها.

منهجية دار الإفتاء الليبية

تولى إصدار هذه الفتاوى المفتي الليبي الرسمي، العالم المعروف بمواقفه المعارضة للظلم والظلمة: الشيخ الصادق عبد الرحمن الغرياني، وأسهم في إخراجها ثلة من علماء ليبيا، تكون منهم فريق للإفتاء الليبي، بلغ عددهم ما يزيد على عشرين فردًا، اتسموا بالتمكن الفقهي والعلمي، منهم من استشهد بسبب مواقفه وفتاواه، مثل الشيخ الشهيد: نادر السنوسي العمراني، رحمه الله. وهو عمل علمي جماعي منظم، ووفق منهجية فقهية متزنة، ومنضبطة، يلحظ ذلك من يقرؤها جميعًا، ولا نرى فيها فتوى شاذّة، أو متعسفة، أو متسيبة، رغم ما يعتور كل عمل بشري من أخطاء، إلا أنها من هذه الجهة فقد سلمت مما ذكرنا.

اعتمدت فتاوى دار الإفتاء الليبية على المذهب المالكي في فتاواها، وهو المذهب المعتمد لدى جماهير الشعب الليبي، إلا بعض المناطق التي يقطن فيها الإباضية في ليبيا، فيتبعون المذهب الإباضي الذي تشتهر به سلطنة عُمان، وبعض مناطق في الجزائر، وتونس.

ولكن الغالبية العظمى لهذه البلدان تتبع المذهب المالكي، كما هو معروف في معظم البلدان التي تلتزم بثوابت معينة في الاتّباع الديني، ففي ليبيا يقرؤُون القرآن على رواية قالون عن نافع، بخلاف معظم دول المغرب العربي الذين يقرؤُون برواية ورش عن نافع، ويتبعون المذهب المالكي في الفقه، والمذهب الأشعري في العقيدة، ومذهب الجنيد في التصوف، أو طريقته.

وفي كل المجلدات العشرة التي صدرت عن دار الإفتاء، تلتزم فيها بالراجح من مذهب مالك، ذاكرة النصوص الفقهية التي تدل على الرأي، من الكتب المعتمدة في المذهب لديهم، ويضيفون إليها الأدلة التي تعضد هذا الرأي الفقهي، كي تطمئن نفس المستفتي لصحة ما أفتوَه به، وليس مجرد تقليد مذهبي للمذهب السائد في ليبيا.

وهو توجُّه محمود يدلّ على حسن مخاطبة الجمهور، كما كانت لغتها سهلة وميسّرة للقارئ، وكذلك غطت مسائل عديدة معاصرة، وذلك بحكم أسئلة الجمهور للدار، وبحكم الأحداث الجارية في ليبيا، فقد فرضت نفسها من حيث الاهتمام والسؤال، وهو ما يلاحظ في تَكرار أسئلة معينة في عدة محاور من الفتاوى، وبخاصة ما يتعلّق بأحداث الثورة وما تلاها من أحداث إدارة الدولة الليبيّة ومشاكلها، ومشكلات الثورة، والثورة المضادّة.

إلا أنَّ هذه الفتاوى فيما تعمّ به البلوى، من مسائل الناس، في عبادتها ومعاملاتها، تذكر مع الرأي المستقر عليه والراجح في المذهب المالكي، ما لدى المذاهب الأخرى من فقه ورأي، مما ييسّر على  الناس، أو مما ينشر بذور التعصب والإنكار فيما هو مختلف فيه، كفتواهم في المسح على الجوارب.

ومعلوم أن شروط المذهب المالكي شديدة في المسألة، حيث لا تجيز المسح عليه، لكن يجيز المذهب المسح على الخفين، ومع ذلك كانت فتوى الدار لمن مسح، بجواز الصلاة خلفه لو صلى إمامًا، لأنه لا تضر المخالفة في بعض السنن، ولا يحق للمخالف الخروج من الصلاة وإحداث الفرقة في المسجد، وفي فتوى أخرى، نقلت الدار آراء المجيزين للمسح على الجوْرب، من باب التوسعة في العلم بالآراء الفقهية.

مساحات مهمة للبحث المجتمعي

بقيت مساحة من البحث العلمي مهمة في الفتاوى، لا تتعلق بالفتوى مجردةً، بل تتعلق بسياقات الفتوى في ليبيا، حيث إن هذه الفتاوى بمجلداتها العشرة، والتي تغطي مساحة عقد من الزمان في تاريخ ليبيا المعاصر المعيش، هي تكشف عن ملامح المجتمع الليبي، وما طرأ عليه من تغيّر، وما ثبت عليه من عادات وسلوك، وما فعلته فيه الثورة، وما تبعها من أحداث تتعلق بالثورة المضادّة، فكثير من الأسئلة وإن حمل فيه تفاصيل تتعلق بسؤال ديني، إلا أنه يحمل بين سطوره تفاصيل في غاية الأهمية عن هذا المجتمع.
