إن متابعتي واهتمامي بموضوع التجربة الدستورية والبرلمانية في ليبيا التي عاشها أبناؤها فترة من الأعوام في ظروف مختلفة تلاحقت وتباينت ثم ظلت بعيدة وراء الأفق في أطياف التاريخ وانتهت بتجربة نيابية ديمقراطية رغم العثرات دامت ثمانية عشر عاما إلى 1969 حيث تعطلت وتوقفت.. إن ذلك يعود إلى أيام بعيدة ماضيات إقتربت والتقيت فيها بكثير من رجال ليبيا الذين أسهموا بجهودهم في إرساء قواعد هذه التجارب العديدة وفي هذا كله يتعين عليَّ خلال هذه المقالات أن أشير إلى بعض منهم وهم السادة: محمود بوهدمة وسليمان الجربي والطاهر العالم.. على سبيل المثال.
لقد كان الأول عضوا في لجنة الواحد والعشرين ثم الجمعية الوطنية (الستين) وكان الثاني عضوا مثله في الستين وفي لجنة الدستور وقام بأعمال السكرتارية وتدوين محاضرها وجلساتها بدقة عالية التنظيم وكانا ضمن وفد إقليم برقة فيما كان الثالث مثلهما في الجمعية إضافة إلى اختياره في فترة لاحقة عضوا بلجنة العمل وإعداد الدستور ضمن زملائه وفد فزان في الجمعية المذكورة. وأضيف إلى ذلك: أن السيد بوهدمة كان رئيسا لأول مجلس تشريعي في ولاية برقة بعد الاستقلال وهي – المجالس التشريعية في الولايات الثلاث – تجربة برلمانية سأتعرض إليها في ثنايا مايبقى من مقالات ثم اختير ثالث رئيس لمجلس شيوخ في المملكة وعينه الملك نائبا له مع رئيس مجلس النواب خلال غيابه عن الدولة عام 1956 قبل تعيين ولي للعهد تلك الأيام. وأن السيد العالم كان نائبا في أول برلمان ليبي بعد الاستقلال في 1952.
التقيتهم في بنغازي وطرابلس مرارا وتحدثوا لي عن هذه المخاضات العسيرة والتجارب التي انقطع عنها الجيل اللاحق وولى لها ظهره دون الإفادة منها أو متابعتها بالتحليل والدراسة والنقد والحوار. دونت وسجلت منهم مما دار في كواليس القاعات والجلسات ووقفت في حقيقة الأمر على قيمة هذه الجهود الكبيرة التي بذلوها مع بقية زملائهم أياما وليالي طويلة بين طرابلس وبنغازي. لقاءات وحوارات وجلسات ونقاشات وجولات وتفاهمات وتناقضات وأخذ ورد وشد وجذب ثم كانت المحصلة الختامية لهذه الجهود الوطنية توحد الخطوات نحو طريق واحدة تؤدي إلى الوطن الواحد الذي يسع الجميع رغم المطالبات والحلم بالمزايا لكل إقليم وكان هناك في كل الأحوال درء وسد لمحاولات النفاذ الأجنبي والتدخل بتغيير وجهة ذلك الطريق.
ولم يكن هذا العمل الوطني المخلص يسعى لتحقيق أطماع أو مأرب شخصية. وكان الحضور والتواجد في طرابلس يتم بالتنقل عبر ظروف صعبة بالبر وأحيانا بالجو في طائرة الأمم المتحدة الوحيدة التي خصصت لمندوبها في ليبيا المستر إدريان بلت. وتظل إحدى أحاديث الشيخ بوهدمة إلي ماثلة في الذهن ولاتنسى فقد ذكر بأنه خلال مشاركته في اجتماعات الجمعية الوطنية عامي 1950و1951 كان يغادر من بنغازي إلى طرابلس مع رفيقه السيد عمر فائق شنيب لحضور تلك الاجتماعات مصحوبين بعائلتيهما. كانت الوسيلة التي تقلهما شاحنة كبيرة ويستغرق سيرها أياما عديدة وكثيرا ما تتعطل تلك الشاحنة في بعض الأماكن البعيدة عبر الطريق الساحلي عن أي وجه من وجوه المساعدة اللازمة. ينتظرون فترة من الأيام والليالي في أيام الصيف والشتاء حتى تصل إليهم أول نجدة للقيام بإصلاح وصيانة الشاحنة. ينتظرون في تلك البقعة الخالية.. يتسامرون ويتحدثون عن شجون الوطن دون شعور بالشكوى أو الألم وعندما يصلون إلى طرابلس كانا يؤجران مسكنا على حسابهما الخاص رغم قلة ذات اليد ويشرعون في حضور الاجتماعات متناسيين تعب الطريق ومشاقه. كانت الطريق الأخرى نحو الاستقلال أكثر مشقة منها.
وظل السيد العالم في أحاديثه عن معاصرته لوضع أسس وبنيان الدولة الوليدة يؤكد على وطنية وحرص الشيخ أبو الأسعاد العالم الذي يجهله الكثيرون وروعة أدائه للجلسات وحسن سيطرته بكل ديمقراطية وإتاحة الفرصة أمام كل الآراء وتقريب وجهات النظر بكل حنكة ودراية. فيما أشار إلى المحاولات الخبيثة التي كان يرمي بها بعض رجال فرنسا في إدارتها في فزان للتأثير عليه وزملائه الذين يمثلون الإقليم سعيا لانفصال الوطن. ذاكرا بأن لجنة العمل في إعداد الدستور ظلت تناقش القضايا والموضوعات دون أي تدخل خارجي من أي طرف. ماعدا الصياغة النهائية في صورتها القانونية من قبل المستشارين عمر لطفي وعوني الدجاني وغيرهما. مشيرا في الوقت نفسه إلى أن من القضايا الحساسة التي غدت مثار اهتمام ومتابعة كثيرة على سبيل المثال هي موضوعات الاتفاقيات الأجنبية وإعلان الحرب والعاصمة.
وفي جملة هذه التفاصيل المهمة التي خرج عبرها الدستور الليبي الذي لم يكن صناعة أجنبية بل كان نتاجا ليبيا وبأيدي ليبية لم تكن عميلة أو يحركها الخارج على أي وجه من الوجوه.. أود أن أستعين بما ذكره صديقي الدكتور محمد الطاهر الجراري الذي كان والده السيد الطاهر عبدالله الجراري عضوا من فزان في لجنة الواحد والعشرين.. فقد سمع ذات يوم من السيد علي رجب المدني عضو اللجنة عن طرابلس هذه القصة التي دارت أيام جلسات اللجنة المذكورة صيف عام 1950 ما مفاده مختصرا في بعض جوانبه: (ذات يوم قام السفير البريطاني في طرابلس بدعوة أعضاء لجنة الواحد والعشرين لمائدة العشاء واختار السطوح مكانا للعشاء في جو رائق. يطل فيه الضيوف الناعم منهم والخشن على مصابيح طرابلس المتلألئة من بعيد أو قريب ومويجات بحرها المتسابقة ونجوم سمائها الصافية ونسائم مسائها المتعانقة وسط الأكل المطروح للراغبين والماء المسكوب للسائلين. فتحولت الجلسة المدروسة وإطارها إلى سمفونية رائعة يتداخل فيها الهواء مع الحضور السماوي والأرضي والمائي فإلى أين المفر أيها الواحد والعشرون؟.
تعمدت في هذا الجو الساحر التأكيد على مصالح من نوبوني عنهم فقصدت أحد ممثلي فزان (وكان والدك المقصود). أطلقت السلام.. فرد. وعرفت بنفسي فقام هو بالرد والترحيب ثم بدأت أناقشه في القضايا المطروحة وقتها للنقاش ومنها العاصمة. فرد بأنه قديم التردد على طرابلس وفيها نبيع ونشتري ونملك ونتزاور مع أقاربنا القاطنين بها. واسترسل في العلاقات بين الجنوب والشمال وحتى عن فشل محاولات فرنسا ربط الجنوب (فزان) بمستعمراتها في المغرب وإفريقيا. سعدت بكل هذه الأحاديث واعتبرتها تقدمة ناجحة لتقديم سؤالي الرئيسي له وهو.. التصويت لصالح طرابلس عاصمة لليبيا. رد: طرابلس اقتصاديا من مصلحتي الشخصية أن تصبح عاصمة حتى تزدهر استثماراتي البسيطة بها.. لكنها عاطفيا وحدها لاتشبع غروري الطامح إلى ليبيا الواسعة!
إستغربت رده ولكنني فهمت منه أننا جميعا ندور في حلقة شكوك وظنون لكنه شخصيا (والدك الشيخ الجراري) أشار إلى أن من يضحك الآن علينا ويهزأ الآن بنا جميعا ومن يخطط لتأكيد مصالحه فينا جميعا (برقة وطرابلس وفزان) هو ذاك الواقف هناك المستضيف لنا الليلة. مشيرا بأصبعه إلى السفير البريطاني!).
في هذه الأجواء الوطنية والحماس والخوف من المجهول والحرص على الوطن رغم محاولات تغليب المزايا لكل إقليم على حده.. ولد الدستورمن أبناء ليبيا. وكان الملك العتيد إدريس قد ألقى خطابا أثناء زيارته إلى طرابلس بتاريخ 21 مايو 1951أشار فيه إلى أنه: فهم أن الدستور الذي تقوم بوضعه الجمعية الوطنية سيشمل إنشاء دولة واحدة ووزارة واحدة وأنه عندما يحدد ذلك ستعدل أنظمة الحكم في الأقاليم الثلاثة حال إعلان الدستور وتنفيذه من وزارات إلى ولايات لها سلطات تشريعية داخلية في تلك الشؤون التي ينص عليها الدستور ..
